Those conditions are to be applied to any sales concluded with Residence of tourism and Services Haute borne, 6 Avenue Halley 59650 Villeneuve d’Ascq. Thereby, the customer acknowledges having read these general conditions of sale and undertakes to respect them.
Those conditions of sale are modifiable at any time, and the conditions applicable will be those in force on the date when the reservation will be carried out.
ARTICLE 1- RATES
Rates quoted are in euros and take into account the VAT applicable on the day of booking. Any change in the applicable rate or any modification or introduction of new legal fees introduced by the competent authorities will be reflected automatically on the prices indicated on the date of the billing.
The rates are per accomodation for the number of people adapted for each format.
The tourist tax is 1,50 euros on 01/01/2018 and the additional local tax of 10% on the tourist tax, 0,15 euros /day/person over 18, this one is not included in the price displayed.
No stay booked before the setting up of a possible promotional offer will be subject to a rate change upon the booking initially agreed.
ARTICLE 2- RESERVATIONS AND MEANS OF PAYMENT
The reservations can be made by mail on the website www.olivarius-lille@olivarius.com, by telephone, by email welcome@olivarius.com, by post, on the spot or on the sites where RTS HB will display.
The reservation will be effective only if the latter is guaranteed by the customer by communicating a valid Credit Card number and after receiving a booking confirmation .
The payment of all benefits will be made directly to the residence.
The residence reserves the right to refuse any reservation in case the Credit Card number is incorrect, the booking incomplete or if the customer does not respect the terms of admission.
The reservations regardless of their origins will be payable in euros only.
RTS HB accepts the following Credit Cards : Visa, Mastercard and American Express.
The reservations can also be paid cash within the limits of the legislation in force, holiday vauchers, RTS HB does not accept checks or others.
ARTICLE 2.1 – Admission conditions
- Presenting the customer’s valid Credit Card
- Presenting the customer’s Identity Card
- 300 euros deposit by bank pre-authorization on the customer’s valid Credit Card.
- Payment on arrival. RTS HB reserves the right to cash the pre-authorization in the following cases :
- Non-payment of the stay
. Degradation of the accomodation
. Excessive dirt
. Theft
. Etc….
ARTICLE 3-FORCE MAJEURE
On By force majeure is meant any event outside the parties having a character both inpredictable and insurmountable that prevents the customer from staying, to carry out all or part of the obligations provided for by the contract. This will be the case as far as transport , or hotel staff strikes or governmental or public riots are concerned.
ARTICLE 4- MODIFICATION AND CANCELLATION OF STAY
Any modification or cancellation of stay will have to be asked in writing, either by mail welcome@olivarius.com, or fax 03 59 35 36 00 or letter.
The application will be effective only when the RTS HB has confirmed its acceptance in writing.
In case of any modification or cancellation, the following conditions apply (except in case of force majeure)
- For any request made within 24hrs of the arrival day, the amount of the first night will be charged, except for groups who will have to request one week in advance.
- In case the customer won’t arrive on the expected day, his Credit Card will be charged the amount of the first night.
- Any stay started is entirely due.
For bookings made through our partners’website, the cancellation will have to be made via the chosen site. The cancellations conditions that apply will be those listed on the site used for the booking.
Any customer who wishes to extend a stay, will have to inform the reception staff at the latest at 10.00am on the expected departure day, in order to know the availabilities and rates conditions.
ARTICLE 5 – THE RESIDENCE AND BENEFITS
Our pet friends are allowed in the residence (500 euros deposit). An additional 10euros/night/animal will be asked. They are not allowed in the breakfast space and all animals have to be supervised by their owners and respect the applicable regulations (specially dogs of caterories 1 and 2).
The apartments are available from 3pm and have to be released by 11 am on departure day. An additional 50% will be charged in case of non-respect of this schedule.
The customer accepts and agrees to use the apartment with care. So, any behaviour contrary to morality and public order will cause the residence staff to ask the customer to leave without any compensation and/or any refund.
ARTICLE 6 – DISLODGING
In case of exceptionnal event or impossibility to make the reserved apartment available, or in case of force majeure, the residence reserves the right to have the client fully or partially housed in a hotel of equivalent category, with the same services and subject to the prior agreement of the customer.
The possible additional cost of the room, transportation between the two residences and a phone call remain the responsability of the residence.
ARTICLE 7- CLAIMS AND DISPUTE RESOLUTION
Any complaint must be sent to the RTS HB by registered aknowledgement of receipt letter within 15 days following the departure , that in the subject of the complaint.
After this period, no claim will be taken in account.
The customer is informed by the RTS HB of the possibility to resort, in case of dispute concerning the present general conditions, to a procedure of conventionel mediation or to any other alternative way of setting the disputes under the condition provided in title of Book VI of the Code of Consumption.
After entering the customer’s service or the residence to reach an amicable agreement, and in case of a negative answer, or the absence of answer within 60 days from the referrial, the customer can seize the Mediator of Paris Arbritration Mediation Centre (contact details and referrial procedures concerning the Mediator are available in the section at the hotel reception on request).
The referrial to the Mediator can be made within 12 months after the 1st complaint. (consommation@cmap.fr)
ARTICLE 8 – IT and FREEDOM
In application of the Law 78-17 known as computing and freedom, the customers are warned that their reservation is the subject of a computerized nominative treatment. Users have the right to access and rectify the data entered, which is exercised at the head office : 6, Avenue Halley 59650 Villeneuve d’Ascq. It is specified that this information is not communicated to third parties.
RTS HB offers wifi internet access.
The customer user agrees that the computer ressources made available to him are in no way used for the purpose of reproduction, representation, secondment or communication to the public of works or objects protected by copyright, by a neighboring right such as texts, images, photos, audio visual images, software and video games withouth the authorization of the holders of the rights provided for in books I and II of the Intellectual Property code, when this authorization is required.
ARTICLE 9- RESPONSABILITIES
The customer will be held responsible for any damage deterioration or vandalism that may occur due to the occupancy of the place and/or because of the participants and/or of the staff for which he/she is responsible, as well as the personnal properties, decoration and real estate belonging or not to the residence. RTS HB may therefore ask the client to leave the residence without any compensation or refund of current stay, and to reimburse the damages caused by these acts.
ARTICLE 10- APPLICABLE LAW
The present general conditions of sale are governed by French Law. This is so for the rules of form as well as for the rules of substance.
The litigation will fall under the exclusive jurisdiction of the French Courts (Court of Lille).
